For Petitioners : Mr.R.Vinodh 1/5 https://www.mhc.tn.gov.in/judis For Respondent-1 :Mr.B.Thanga Aravindh Govt.Advocate(Crl.side) O R D E R The present petition has been filed by the accused No.7,9 and 11 in in P.R.C.No,.7 of 2026, on the file of learned Judicial Magistrate Court No.II, Sivagangai,wherein, the Petitioner has been charged with the offence under Sections 191(2), 191(3) and 103(2) of BNSS,2023. 2.According to the learned counel for the Petitioners, the deceased person had stolen the boat and they were got red handed by the general public who attacked them. In such circumstances, the question of invoking Section 103(2) of BNSS, 2023 does not asrise. He further submitted that there is no specific overtact attributed against the Petitioners/A7, A9 and A11. 3.I have carefully perused the charge sheet and the connected documents. 4.This Court is of the view that if there is any specific overtact against the Petitioners herein, it is for the trial Court to conduct the trial and decide the nature of the charge made against 2/5 https://www.mhc.tn.gov.in/judis them. Hence the trial Court is directed to dispose of the proceedings pending against the Peititoners without being influenced by any of the observations made by this Court.This Court is not inclined to entertain the present petition as no legal ground made out by the Petitioners to quash the criminal proceedings pending against them. 5.In view of the above facts, the Criminal Original Petition stands dismissed.
