THE EXECUTIVE ENGINEER, ANANTHAPUR TOWN, ANANTHAPUR. -515001 ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased tossue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction on part of the Respondents No.2 to 6 in considering our candidature for promotion to the post of Senior Assistant from the post of Junior Assistant in the panel year 2025-2026, even though there are clear vacancies, in order to accommodate persons of their choice and we are eligible for promotion contrary to the Memo No.SE/O/ATP/EE/T/PO/JAO/Adm/S3/D.No.4229/2023, dated 28.01.2023 and eontrary to Regulation 8 of Part II of APSEB Service Regulations as arbitrary, illegal, eolourable exercise of power and apart from being violative of the fundamental rights guaranteed under Articles 14, 16, 19 and 21 of the Constitution of India and consequently, direct the Respondents to our candidature for promotion to the post of Senior Assistant from the post of Junior Assistant in the panel year 2025-2026 by way of conducting DPC for the same IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased direct the Respondents to consider the Representation, dated 31.08.2026 and further, direct them to not affect our future promotions on this basis pending disposal of the case Counsel for the Petitioner(S): 1. GP FOR SERVICES II The Court made the following: 3 ORDER: The present Writ Petition is filed questioning the inaction of respondents in not considering the petitioners for promotion to the post of Senior Assistant for the panel year 2025-2026, despite clear vacancies. 2. The petitioners were initially appointed as Junior Linemen in the year 2007 pursuant to a recruitment notification. Thereafter, they were promoted as Junior Assistants in the year 2012 and are due for promotion to the post of Senior Assistants. As the case of the petitioners are not being considered by the respondents, while the individuals who were promoted to the post of Senior Assistants subsequent to that of the petitioners are being considered, the present Writ Petition is filed on the said ground. 3. Learned Assistant Government Pleader for Services-II passed on signed instructions dated 09.09.2026 of the Superintending Engineer, Operations, Anantapur, wherein it is stated that seniority list was not prepared after bifurcation in Anantapur circle, as some of the persons who were allocated did not join at their place of posting. It is stated that, after all the employees joined at their allocated places, the provisional seniority list in all cadres in Accounts service was prepared and communicated to all employees on 06.08.2026. In the absence of final seniority list, the DPC could not be conducted. It is further stated that DPC will be conducted as soon as possible duly considering the candidature of the petitioners according to their seniority and eligibility. The said instructions are placed on record. 4 4. In the light of the grievance of the petitioner is redressed, the Writ Petition is disposed of, directing the respondents to conduct DPC as expeditiously as possible, in terms of the instructions dated 09.09.2026.
