Pursuant to the contentions advanced on behalf of the petitioner, a report was called for. The report reflects that the condition was imposed upon the private opposite parties, namely, Prabhu Mondal, Sanjay Mondal and Bijay Mondal to stay outside the jurisdiction of South Port Police Station for a period of three months from 19.11.2024. The report also speaks that there is dispute relating to video footage which was relied upon being recorded in the month of March, 2023 and the condition which was imposed by this court on 19.11.2024. Having regard to the emphasis of the learned advocate for the petitioner for cancelling the bail on the grounds of petitioner 2 violating the conditions imposed, I find that the report of the police authorities do not support the contention of the present petitioner. Be that as it may, since a criminal case is pending, the petitioner and all the accused persons are obviously in bad terms. Moreover, there are accusations of violation relating to the offence under Section 354B of the IPC along with other relevant Sections. Accordingly, it is directed that if there are any inconvenience faced by the petitioner and the same is brought to the notice of the police authorities, the police authorities would take prompt action according to the need of the situation. The prayer for cancellation of bail is refused at this stage. With the aforesaid observations, CRM (DB) 4447 of 2024 is disposed of. Report submitted be kept with the record.
