Taking into consideration the observations made by the learned Single Judge that the disciplinary authority would not be bound to accept the enquiry report and would have to re-appreci- ate the defence to come to the conclusion whether it is concurrent with the finding of the enquiry officer or not, it is sufficient for us not to interfere with the judgment passed by the learned Single Judge. The petitioner is always free to take up all his objections

2. In view of the above, the present special appeal stands dismissed.
