This is the First bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.97/2026 registered at Police Station- Akaltara, District- Janjgir-Champa (C.G.) for the offence punishable under Section 69, 64(2)(M), 296 of the BNS, 2023. 2. Facts of the case are that the complainant/ victim had lodged the report in Police Station Akaltara, alleging therein that her husband expired prior to 4 years and she has no issue and VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.05.04 14:35:52 +0530 2 resident in Village Piparsatti. In the month of April, 2025, the applicant gave lift to her in dropping from Village Piparsatti to Akaltara. Thereafter they well acquainted to each other. During which the victim had gave Rs. 2,26,000/- to the applicant, thereafter on the pretext of marriage, the applicant had developed physical relation with the victim. Based on the report FIR has been registered against the applicant. Hence, this bail application. 3. Learned counsel for the applicant submits that applicant is innocent and has falsely been implicated in the present case. He also submits that victim is a major women aged about 60 years and during the medical check-up no any internal or external injuries found on the body of the victim. It is further contended that applicant is in jail since 19.02.2026 and the conclusion of trial is likely to take some time, therefore, he prays for releasing the applicant on regular bail. 4. On the other hand, learned State counsel opposes the bail application and submits that on the pretext of marriage applicant made physical relation with the victim and obtained Rs. 2,26,000/- from the victim, therefore, he is not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. From perusal of the records, submissions made by learned counsel for the party, nature of allegation and also considering the fact that on the pretext of marriage applicant made physical 3 relation with the victim, who is aged about 60 years and obtained Rs.2,26,000/- from the victim, this Court is of the opinion that it is not a fit case to enlarge the applicant of bail. 7. Accordingly, the instant bail application of the applicant- Aditya Sandilya, involved in Crime No.97/2026 registered at Police Station- Akaltara, District- Janjgir-Champa (C.G.) for the offence punishable under Section 69, 64(2)(M), 296 of the BNS, 2023, is rejected at this stage. 8.
