Criminal Miscellaneous Bail Application No. 6933/2026 URN: CRLMB / 12518U / 2026 Sriram S/o Shri Chittar, Aged About 52 Years, R/o Mandiyon Ki Dhani, Dhamana, Police Station Maujmabad, District Jaipur, Rajasthan. (At Present In Sub Jail, Sambhar Lake, District Jaipur). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Sneh Deep Khyaliya For Respondent(s) : Mr. Jaiprakash Tiwari, PP Mr. Rajesh Maharshi with Mr. Devanshu Saini Ms. Vaishnavi Pareek HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 14/07/2026 1. The petitioners have filed these bail applications under Section 483 of BNSS in FIR No.79/2025 registered at Police Station Maujmabad, District Jaipur Rural for offences under [2026:RJ-JP:26637] (2 of 3) [CRLMB-6932/2026] Sections 189(2), 191(2), 191(3), 126(2), 115(2), 109(1) and 103(1) of BNS, 2023. 2. Since both these bail applications arise out of common FIR, hence, they are being decided by this common order. 3. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record. 4. Learned counsel for the petitioners contends that the petitioners have falsely been implicated in these cases. He submits that petitioner Chandalal has not been named in the FIR. The principal allegation of causing injuries to the deceased-Bajrang has been levelled against the co-accused Ram Singh Dudi. It is further submitted that no specific allegation has been attributed to the present petitioners. Moreover, similarly situated co-accused Rameshwar and Gajanand have already been enlarged on bail by the Coordinate Bench of this Court vide order dated 24.03.2026 and co-accused Jawahar Lal has also got benefit of bail by Co- Ordinate Bench of this Court vide order dated 22.01.2026. Petitioners are behind the bars since 12.09.2025 and 13.08.2025 respectively though one case each has been reported against petitioners, however, in that case they are already on bail. Charge-sheet has already been filed. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody, consequently, on merits as well as on ground of parity, the bail applications deserves to be allowed. 5. Learned Public Prosecutor and learned counsel for the complainant have vehemently opposed the bail applications of the petitioners. [2026:RJ-JP:26637] (3 of 3) [CRLMB-6932/2026] 6. On consideration of the rival submissions and material available on record and in the light of submissions made by learned counsel for the petitioners but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners. 7. Consequently, the bail applications under Section 483 B.N.S.S. are allowed and it is directed that the petitioners Chandalal So Shri Mangilal & Sriram S/o Shri Chittar be released on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that each of them shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
