Mr. Mukesh Singh Rawat, learned counsel for the applicant. 2. Ms. Sweta Dobhal, learned Brief Holder for the State. 3. By the instant petition, the present applicant is challenging the proceeding on the ground that the injuries are not so fatal which constitutes an offence punishable under Section 307 IPC. Apart from this, he submits that no specific role has been assigned to the present applicant and it is completely an abuse of process of law. 4. On the other side, Ms. Sweta Dobhal, learned Brief Holder for the State at this juncture submits that in the petition preferred under Section 528 of BNS 2023, appreciation of evidence can be looked until and unless the case which falls under seven categories of cases as categorized by the Hon’ble Apex Court in the case of State of Haryana and others vs. Bhajan Lal and others, 1992 Supp (1) SCC 335 which still holds good law. 5.
