By the instant petition preferred under Section 528 of BNSS, 2023, the present applicant – Jash Bahadur Singh Chauhan, is praying for expeditious disposal of the Criminal Case No.292 of 2022, “State Vs. Awadh Bahadur Singh” which pertains to the offences punishable under Sections 420, 467, 468 and 471 of IPC, which is pending in the court of Judicial Magistrate, Doiwala, District Dehradun.
5. Learned counsel for the applicant submits that the present applicant as well as the respondent/complainant, both are the cousin brother, and are senior citizens and taking into consideration their age, the Trial Court be directed to expedite the trial within some time framework.
6. The relief as sought appears to be innocuous, though on the previous date, the matter is posted for today so that both the cousin brother may settle their dispute amicably, but it completely fails.
7. In such view of the matter, this Court has no other option except to direct the Trial Court to expedite the trial court proceeding by keeping in mind that both are senior citizen, and make all possible efforts to expedite the trial on day-to-day hearing basis.
8. In such view of the matter, the instant C528
application is disposed of finally, and the concerned Trial Court is directed to expedite the proceedings of the Criminal Case No.292 of 2022, “State Vs. Awadh Bahadur Singh”, pending in the court of learned Judicial Magistrate, Doiwala, Dehradun, as early as possible, preferably within three months from the date of production of the certified copy of this order.
