IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No. 122 of 2026 Sanjaya Kumar Ghosh …. Petitioner Mr. P.C. Jena, Advocate -versus- State of Odisha …. Opposite Party Mr. S. Panda, ASC CORAM: JUSTICE V. NARASINGH Order No. ORDER 09.01.2026 01. 1. Heard learned counsel for the Petitioner and learned counsel for the State. 2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.291 of 2024 pending on the file of learned J.M.F.C., Banarpal arising out of Banarpal P.S. Case No.110 of 2024 for commission of offences punishable under Sections 379/120-B of IPC and Section 51 of the Orissa Minor Mineral Concession Rules, 2016. 3. It is submitted by the learned counsel that because of the conflicting business interest, the Petitioner has been falsely implicated. Hence, he may be protected by pre-arrest bail. 4. It is further submitted that making similar allegations, Petitioner has been cited as an accused in number of cases. 5. Learned counsel for the State opposes the prayer for bail and submits that since the Petitioner has criminal antecedents, he ought not to be released on pre-arrest bail. 6. Taking into account the nature of allegations and the punishment prescribed, it is directed that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper subject to verification of criminal antecedents other than the similar nature. In the event the Petitioner has any criminal antecedents other than the similar nature this order shall not be given effect to. 7. Accordingly, the ABLAPL stands disposed of. (V.
