For Respondent No. 5 : Mr. Jitendra Pali, Advocate along with Ms. Siddhidatri Kashi, Advocate Digitally signed by AJINKYA PANSARE Date: 2026.04.23 16:59:01 +0530 2 Hon’ble Shri Justice Rakesh Mohan Pandey Order On Board 23.4.2026 1) By way of this petition, petitioner has sought following reliefs:- 10.1 That, the Hon'ble Court may kindly be pleased to direct the respondent authorities to remove the name of Respondent no. 04 to 06 from the gradation list being maintained by Respondent no. 02. 10.2 Alternatively, the Hon'ble Court may kindly be pleased to direct the respondent authorities to decide a fresh representation of the petitioners in a time bound manner. 10.3 That, the Hon'ble Court may further pass any order which it may deem fit, in the interest of justice. 2) At the very outset, learned State counsel submits that petitioner has challenged the gradation list of year 2018 which was prepared by the respondent department keeping in view the gradation lists of years 2016 and 2017 where petitioner was placed below respondents No. 4 to 6, therefore name of petitioner appears below respondents No. 4 to 6 in the gradation list of year 2018. He further submits that petitioner has already been promoted to the post of Professor vide order dated 28.2.2022. 3) Heard. 4) As petitioner has already been promoted to the post of Professor, petitioner would be entitled to claim notional benefits like seniority 3 etc. from the date when her juniors were promoted, therefore this petition at this juncture is hereby being disposed reserving liberty in favor of petitioner to make a detailed representation before Director, Directorate Of Medical Education, State of Chhattisgarh within period of 30 days from today. It is expected that the authority concerned shall shall decide the petitioner's representation by way of a speaking order within 90 days of receiving a copy of the same. 5) With the aforesaid direction, this petition stands disposed.
