GP FOR HOME 3 THE HONOURABLE SRI JUSTICE MAHESWARA RAO KUNCHEAM WRIT PETITION NO: 26314 of 2024 The Court made the following Order: Instant Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief: “to issue a Writ of Mandamus, or any other appropriate writ, order or direction, declaring the actions of the 2nd and 3rd respondents in interfering with the life and personal liberty of the petitioner by calling to the police station threatening to open a Suspect Sheet as illegal and arbitrary and violation of Articles 19, 21 of Constitution of India and consequently direct the 3rd respondent not to interfere with the petitioners life and personal liberty and pass”. 2. On 07.09.2026 as well as today no representation for the petitioner. 3. Learned Assistant Government Pleader for is in attendance and stated that counter has been filed. 4. As there is no representation for the petitioner, this Court gone through the material on record and the counter affidavit shows that the petitioner is involved in two (2) crimes Crime and suspect sheet was also opened against him. The crimes in which the petitioner involved are No.243 of 2024 on the file of II Town Police Station, Vijayawada under Sections 323, 506 r/w 34 IPC, 156(3) Cr.P.C. in which the petitioner was arrayed as accused 4 No.10, the said case was investigated, charge sheet was filed and the case is PT vide CC No.2141/2024, dated 13.06.2024 and the petitioner was bound over for good behavior for a period of six (6) months under Section 107 Cr.P.C. by the Mandal Executive Magistrate of Vijayawada West vide M.C.No.339/2024 dated 21.05.2024. As the petitioner along with his followers, was violating model code of conduct during the general elections of 2019 and 2024, Suspect Sheet (L&O) vide C.No.17/HS/ACP- WD/2024, dated 24.05.2024 was opened against him by the Assistant Commissioner of Police, West Division, NTR Police Commissionerate, Vijayawada to keep a watch on his movements to prevent unlawful activities in future. 5. Recording the submissions made by the learned Assistant Government Pleader for Home, the Writ Petition is closed. However, the petitioner is liberty to workout legal remedies in accordance with law. No order as to costs.
