JUSTICE JAYANT BANERJI) When the matter was listed on 12.02.2026, the following order was passed: “Learned Counsel for the appellant is permitted two weeks and no more time to remove the office objection/s, failing which the appeal shall stand dismissed without any further reference to this Court.” The I.A. No.2/2026 is filed seeking recall of the order inasmuch as the appellant was not able to comply with the office objection/s within the time granted by the Court. In the affidavit filed in support of the application, illness of the counsel is cited as a reason. However, we note that the appeal was filed on 14.01.2026 and the order sought to be recalled was of 12.02.2026. The illness of the counsel has not been demonstrated to extend since the date of filing of the appeal. However in the interest of justice, I.A. No.2/2026 is allowed.
