Copy of the report is made over to the learned counsel for the petitioner in Court this day. None appears for the Panchayat and the private respondents despite service. The petitioner alleges that the private respondents are transforming an old well into a septic tank adjoining the boundary wall of the petitioner which is creating nuisance and health hazards for the petitioner and his family members. The petitioner seeks to submit a comprehensive representation in this regard before the Pradhan, Jamragam Mondal Gram Panchayat, being the 2nd respondent herein, within 7 days from date. Such liberty is granted. The 2nd respondent is directed to consider and dispose of the same within six weeks from the date of receipt thereof upon granting reasonable opportunity of hearing to all concerned including the petitioner and the private respondent, in accordance with law. The decision taken by the authority shall be communicated to the parties within a week thereof. The writ petition is disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
