IN THE HIGH COURT OF HIMACHAL PRADESH AT SHIMLA
CWP No.8082 of 2026
Decided on 21st May, 2026 Desh Raj and another
…Petitioners Versus State of H.P. and others
…Respondents Coram Hon’ble Mr. Justice Ajay Mohan Goel, Judge 1Whether approved for reporting? For the petitioner: Mr. Vijay Kumar, Advocate.
For the respondents: Mr. Pushpinder Jaswal, Additional
Advocate General.
Ajay Mohan Goel, Judge (Oral)
Issue notice. Mr. Pushpinder Jaswal, learned Additional Advocate General, accepts notice on behalf of the respondents.
2.
The grievance of the petitioners is that the arrears, which stand sanctioned in their favour in terms of Annexure P-5, which approximately comes to Rs.3.80 lac in the case of each of the petitioners, are not being released to the petitioners in a lump sum, and only an amount of Rs.68,000/- approx., each has been released in faviour of the
petitioners. Learned counsel for the petitioners has argued that as the arrears relate to the years 2019 to 2023 and the amount is not all that huge, payment thereof in installments to the petitioners does not serve the purpose and respondents be directed to pay the balance amount lump sum to the petitioners.
3.
On the other hand, learned Additional Advocate General submits that in light of the decision taken by the Government to pay the amount in installments, needful is being done by the Department.
4.
Having heard learned counsel for the petitioners as also learned Additional Advocate General, this Court is of the considered view that as now approximately an amount of Rs.3.20 lac is payable to each petitioners, interest of justice would be served in case this petition is disposed of with the direction that let this amount be released either in lump sum or in installments in favour of the petitioners but on or before
31.12.2026. Ordered accordingly.
5.
This petition is disposed of with the direction that the balance of the arrears which is payable to the petitioners be released in their favour either in lump sum or in installments, but, on or before 31.10.2026.
