Heard Mr. D K Bhattacharyya, the learned counsel appearing for the petitioner. Also heard Mr. P S Lahkar, the learned Additional Public Prosecutor appearing for the State of Assam.
2. This application has been filed under Section 438 read with Section 442 of the BNSS, 2023 challenging the order dated 17.11.2025 passed by the learned Special
Page No.# 2/2 Judge, Sribhumi in Bazaricherra P.S. Case No. 134/2025 under Sections 22(c)/25 of the NDPS Act.
3. In the said case, a truck bearing registration number AS-01-EC-0528 was seized by police. The petitioner is the registered owner of the said truck. The truck was given to a transport company, namely, “M/S EITA Logisolution Pvt. Ltd.” In fact, the truck was run by the said transport company. The registered owner received the rent only. The truck was found to be carrying a large number of cough syrup.
4. I have considered the submissions made by the learned counsel of both sides.
5. This Court is of the opinion that keeping the said truck in custody will not serve any purpose.
6. Therefore, the prayer of the petitioner is allowed.
7. The truck bearing registration number AS-01-EC-0528 shall be given to its registered owner on payment of a bond of ₹1 lakh. With the aforesaid direction, this Criminal Revision Petition stands disposed of.
