Kausik CRM (M) 2482 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Bhagwangola Police Station Case No. 362 of 2024 dated 12.07.2024 under sections 126(2)/115(2)/117(2)/118(2)/109/103(1)/3(5) of the BNS, 2023. And In the matter of : Abdul Basir @ Basir Sk. @ Basiruddin Sk. ……Petitioner. Mr. Satadru Lahiri Mr. Somnath Adhikary ……for the Petitioner. Mr. Subhomay Bhattacharyya Ms. Sanjida Sultana ……for the State. Learned advocate appearing for the petitioner submits petitioner is in custody for 1 year and 7 months and although the charge has been framed but till date no witness has been examined and the prosecution intends to examine 28 witnesses in support of its case. Learned advocate for the State has drawn the attention of the Court to the statement of one of the injured under Section 164 of the Code of Criminal Procedure/Section 183 of the BNSS. I have taken into account the chain of events appearing in the case diary as also the genesis of the dispute. Having 2 considered the same, I am of the view, at this stage, it will not be fit and proper to release the petitioner on bail. Learned Trial Court is directed to examine the injured witnesses. It has been contended that CSW 6, CSW 8 and CSW 9 are the injured witnesses. Learned Trial Court would assess if there are other injured witnesses. Priority be given for examination of such witnesses and the same be concluded within a period of 4 months from the date of communication of this order. Petitioner will renew his prayer for bail after the evidence of the injured witnesses are over. At this stage, CRM (M) 2482 of 2025 is dismissed. Report submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
