Learned advocate appearing for the petitioners submits the subject matter of case relates to alleged recovery of 400 bottles of phensedyl from the possession of the two other accused persons and the petitioners have been implicated on the basis of statement of the co-accused. So far as the petitioner no. 1 is concerned there are criminal antecedents as such his prayer for bail was earlier rejected. Learned advocate submits that the charge-sheet has been submitted before the jurisdictional Court as such petitioner may be released on bail. 2. Learned advocate for the State opposes the prayer for bail because of the antecedents of the petitioner no. 1. 3. Having considered the quantum of seizure, period of detention and there are 28 witnesses on whom prosecution 2 proposes to rely in order to prove its case, I am inclined to release the petitioners on bail. 4. Accordingly, the prayer for bail of the petitioners is allowed. The petitioners, namely, Jibrail Karikar @ Gibrail @ Jibu and Nofar Sk @ Nafar Sk @ Nafar Sekh shall be released on bail upon furnishing a bond of Rs.20,000/- (Rupees Twenty Thousand Only) each with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court under NDPS Act, Nadia, Krishnagar. If on bail, the petitioners shall be physically present on each and every date fixed by the learned trial court and shall not leave the jurisdiction of the district of Nadia, without the prior permission of the learned special court. 5. Accordingly, CRM (NDPS) 642 of 2026 is allowed. 6. Memo of evidence submitted be kept with the record. 7. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. 8. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
