Das, learned counsel for the petitioner has submitted that due to in advertence, some of the necessary parties could not be impleaded as party-respondents in the instant writ petition. Ms. N. Bordoloi, learned Standing Counsel, Revenue Department for the respondent no. 1 is present. Mr. J. Handique, learned Junior Government Advocate, Assam for the respondent nos. 2 & 3 has submitted that the petitioner’s claim is for Zirat compensation is relatable to the provisions of the National Highways Act, 1956 and in this writ petition, none of the respondents is an authority under the National Highways Act, 1956. Therefore, this writ petition entails dismissal at the threshold due to non-impleadment of the necessary party- respondents. In view of the above submission made by Mr. Das, learned counsel for the petitioner, the writ petition is dismissed on withdrawal, with the liberty to file afresh with proper details and with impleadment of the necessary parties.
