D/L138 17.04.2026 Bpg. Rejected C.R.M. (M) 678 of 2026
In Re: An application for bail under Section 439 of the Code of Criminal Procedure, 1973 corresponding to Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 filed in connection with Kaliganj Police Station Case No.168
of 2015 dated 04.05.2015 under Sections 147/148/149/448/326/307/302/436/427/379/120B of the Indian Penal Code read with Sections 27/35 of the Arms Act and Section 9B of the Explosives Act, 1884;
Rabir Sk and Ors. Versus The State of West Bengal
Mr. Arijit Bose. …for the petitioners.
Mr. Sandip Chakraborty Ms. Debjani Sahu. …for the State.
Learned advocate appearing for the petitioners submits that the petitioners have been arrested pursuant to the execution of the harsher process of law which were not earlier given effect to and are in custody after the arrest for 1 year 4 months.
Learned advocate for the State opposes the prayer for bail and submits that other accused persons who were arrested they have already been convicted.
The case is of the year 2016. The petitioners evaded the process of law for more than 9 ½ years. Having regard to the long period of absconsion and that some time will be required by the prosecution to organize the witnesses after such a long time, I am not inclined to release the petitioners on bail.
