1. Mr. Nitin Tiwari, Advocate holding brief of Mr. C.K. Sharma, learned counsel for the petitioners.
2. Mr. N.K. Papnoi, learned Standing Counsel for the State of Uttarakhand.
3. Petitioners applied for caste certificate by contending that they belong to Jaunsari Community, which is declared as Scheduled Tribes. Their application(s) was rejected by Tehsildar Tyuni, District Dehradun. Thus, feeling aggrieved, petitioners have approached this Court challenging the rejection order.
4. Perusal of the order impugned reveals that in the Family Register, petitioners are shown to be belonging to General Category.

Learned counsel for the petitioner submits that petitioners’ family is residing in Jaunsar Bawar Region since 1952, therefore, petitioners are entitled to be declared as Scheduled Tribes.
6. Learned State Counsel has drawn attention of this Court to an affidavit filed

2026:UHC:7685 by Principal Secretary, Social Welfare Department. Para 9 of the said affidavit is extracted below:-
9. That it is also pertinent to mention here that, as per the report of Tehsildar Tyuni, District Dehradun, it was apprised that the Grandfather of the petitioners was not the original resident of Village Brinad Tyuni, District Dehradun. The ancestors of the petitioners originally belong to Village Dhari, Post Kaliyasaur, Tehsil Kirti Nagar, District Tehri Garhwal.
7. As per the Presidential Notification, Jaunsari Community is declared as Scheduled Tribes. Petitioners contend that petitioners’ forefather migrated from Kirti Nagar in Tehri District to Tyuni of District Dehradun. Merely because grandfather of the petitioners migrated to Tyuni Tehsil will not entitle them to claim status of Scheduled Tribes.
8. The reply given in para 9 of the affidavit filed by Principal Secretary, Social Welfare Department is complete answer to the issue raised by petitioner.
9. Thus, there is no scope for interference with the writ petition. Accordingly, the writ petition fails and is dismissed.
