Heard the learned counsels for the parties. 2. The grievance of the petitioner is that his candidature has been cancelled for the appointment to the post of graduate-trained teacher for Biology/Chemistry subject which was issued pursuant to Advt. No. 21 of 2016 only on the ground that he is over age by one day. ( 2026:JHHC:12678 ) 2 3. A counter-affidavit has been filed wherein there is specific averment that the petitioner was not within the age limit as per the advertisement criteria, wherein the maximum age limit was 40 years for general category candidate but the petitioner was 40 years one day old. 4. There is nothing on record to suggest that the respondents are having any discretion to relax the date. 5. Accordingly, no relief can be granted to this petitioner, in this factual background. 6.
