This petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is directed against an order dated 15.05.2026, by which bail granted to the petitioner herein was cancelled by the learned Trial Court on the ground that one of the conditions, namely implementation of a settlement agreement, has not been complied with. 3. Without getting into the merits of the petition at this stage, Ms. Rebecca M. John, learned Senior Counsel for the petitioner, and Mr. Som submit that the parties have since entered into a new Settlement Agreement (Comprehensive and Final) dated 16.05.2026, which contemplates transfer of immovable properties comprising of three apartments, and payment of Rs. 1,51,32,000/- in three instalments by the petitioner to respondent Nos. 2 and 3. A copy of the said Settlement Agreement has been handed over in Court by Ms. John, and is taken on record. 4. Ms. John submits that the Agreements to Sell, in respect of the immovable properties, have already been executed, and an amount of Rs.76,82,000/- out of the settlement amount has also been paid. 5. He, therefore, submits that the petition be adjourned by one week, and the order cancelling bail be stayed in the interim. 6. In view of the aforesaid statement, the order dated 15.05.2026 is stayed until the next date of hearing before this Court.” 2. Mr. Satish Rai, learned counsel for the petitioner, and learned counsel for respondent Nos. 2 and 3 submit that the settlement agreement dated 16.05.2026 has since been complied with. 3. The order of the Sessions Court dated 15.05.2026 cancelling the bail granted to the petitioner was predicated only upon non-compliance of the earlier settlement between the parties. 4. The aforesaid position has been overtaken by the execution of a fresh settlement agreement which has already been complied with. 5. In view thereof, and with the consent of learned counsel for the parties, the order dated 15.05.2026 is set aside, without any comment on the merits of the case. 6. The petition is disposed of.
