By means of this writ petition, petitioner has sought the following reliefs:- I. Issue a writ order or direction in the nature of certiorari to quash the current constitution of town vending committee of Mussoorie, Dehradun contained as Annexure No. 02 to this writ petition II Issue a writ order or direction in the nature of mandamus directing the respondent no. 1 and 2 to reconstitute the Town Vending Committee strictly in accordance with the Street Vendors Act 2014, ensuring proper election of vendor representatives. III. Issue a writ order or direction in the nature of mandamus directing the respondents nos. 1 and 2 to conduct a fresh transparent survey and issue certificates of vending to all eligible vendors. IV. Issue a writ order or direction in the nature of mandamus commanding and directing the Respondent no. 2 to allow the vendors to return to their original spots on Mall Road, specifically for the evening hours (after 4.00Pm) until a proper safe and viable vending zone is developed and the legal survey and certification process is completed. Mr. Lalit Miglani, learned counsel appearing for respondent no. 2, on instructions, makes a statement that the writ petition has become infructuous due to supervening event. He submits that reliefs, as claimed in prayer nos. I & II, do not survive, as Town Vending Committee of Dehradun-Mussoorie has been dissolved by Executive Officer of the concerned Nagar Palika and thereafter re-election was also held and election process has now been concluded. 6. As regards to prayer no. III, Mr. Lalit Miglani, Advocate submits that after undertaking fresh exercise for identifying street vendors, licences have been issued to all the street vendors, therefore, prayer no. III do not survive. 7. As regard to prayer no. 4, Mr. Miglani submits that a Vending Zone has been identified and all the Street Vendors, who have been granted licence, are permitted to sell their merchandise from that Vending Zone; thus he submits that all the grievances raised by petitioner have been redressed. 8. The writ petition is, accordingly, disposed of by taking the statement made by Mr. Lalit Miglani, learned counsel for respondent no. 2, on record. However, petitioner shall be at liberty to seek recall of this order, if any of the above statement is found to be incorrect.
