This Writ Petition has been filed for the following reliefs:- 10.1 That this Hon'ble court kindly be pleased to pass similar order in terms of order dated 14.06.2023 and 11/07/2023 in WPC No. 2468/2023 and wpc no. 3058/2023 (ANNEXURE P-3). In which the Honorable Court has passed orders to decide the 4 applicant's application within 90 days and pay the compensation amount to the non-applicants. 10.2 Any other relief, which this Hon'ble Court may deem fit and proper, may also be passed in favour of the petitioner. 2. It is submitted by counsel for the petitioners that all the petitioners are owners of land situated in village Thakurdiya, Post Parsadih, Tahsil Bilaigarh, District Sarangarh Bilaigarh C.G. It is further submitted that all the petitioners are agriculturists and their respective lands are coming under sub mergence on account of construction of Basantpur Bairaj over Mahanadi River. On 23.09.2025 representation (Annexure P/1) has been moved for compensation before the Collector District sarangarh-bilaigarh and again on 19.12.2025 (Annexure P/2) second representation has been preferred before the Collector District sarangarh-bilaigarh but till date, no land acquisition proceeding has been initiated by the respondents. He submits that the issue in hand has already been decided by coordinate Bench in WPC No.2468 of 2023 (Surendra Kumar and Others vs. State of Chhattisgarh and Others) decided on 14.06.2023, therefore it is prayed that this petition may also be disposed of in terms of the observation/direction made in paragraph 4 & 5 of the said order. 3. Learned State counsel would not dispute the aforesaid prayer. 4. It would be apt to quote paragraph No.4 & 5 of the order dated 14.06.2023 which is as under: 4. After considering on the submissions and perusing the documents filed along with the petition, this petition is disposed off at motion stage. The petitioners are granted liberty to file a fresh representation before the respondent authorities within a period of 15 days starting from today. After filing of such representation by the petitioners, the respondent authorities are directed to verify the claims made by the petitioners, initiate acquisition proceeding, if 5 necessary, and also determine the compensation in favour of the petitioners in case the land of the petitioners has been utilized as submergence area of the Basantpur Barrage, by the respondent authorities within a period of 90 days. 5. With the aforesaid observations, this petition is disposed off. 5. Since in the relief clause itself, the petitioner has sought that this petition may be disposed of in terms of the observation/direction made by this Court in paragraph No.4 & 5 of the order dated 14.06.2023, this Writ Petition is disposed of in terms and in line with the observation/direction made by this Court in paragraph No.4 and 5 of the order dated 14.06.2023. 6. However, notwithstanding anything above, petitioners shall approach the authorities concerned within a period of 30 days from the date of passing of this order.
