Hawari, the learned counsel for the applicant/petitioner. 2. This is an application u/s 430(1) BNSS for suspension of sentence passed by the learned Additional Sessions Judge, Dibrugarh, Assam in Criminal Appeal No. 35(3)/2024 thereby affirming the judgment & order dated 26.07.2024 passed by learned CJM, Dibrugarh in N.I. Case No. 160/2018 and thereby sentenced to undergo S. I. for a period of 5 months and to pay fine of Rs. 5,00,000/- with default stipulation. 3. Mr. Hawari, the learned counsel for the applicant/petitioner submitted that the operation of sentence passed by the learned Appellate Court as well as the learned Court of CJM be stayed/suspended till disposal of the connected revision petition and the petitioner may be allowed to remain on his previous bail till disposal of the connected revision petition. 4. Considering the submission made by learned counsel for the applicant/petitioner, the present application is allowed. 5. Operation of the sentence passed by the learned Additional Sessions Judge, Dibrugarh, Assam in Criminal Appeal No. 35(3)/2024 vide judgment & order dated 17.11.2025 thereby affirming the judgment & order dated 26.07.2024 passed by learned CJM, Dibrugarh in N.I. Case No. 160/2018 is hereby stayed/suspended till disposal of the connected revision petitioner. 6.
