Mr. Mamta Bisht, petitioner is present in-person. Mr. Rakesh Kumar Joshi, learned AGA for the State. 2. By means of the present writ petition, the petitioner has inter alia, sought effective and expeditious investigation in FIR No. 0055 of 2025 registered at Police Station Bhowali, District Nainital under Sections 316(2) and 318(2) of the BNS, 2023. 3. According to the petitioner, the FIR was lodged by her being FIR No. 0055/2025, dated 30.08.2025, under Section 316, 316(2), and 318(2) of the BNS 2023, at Police Station Bhowali, District Nainital. 4. The grievance as raised by the petitioner in-person is that the Investigating Officer has submitted the final report before the SSP Nainital in the month of January 2026, and the SSP Nainital directed the Investigating Officer for further investigation. The petitioner further states that the investigation has not been carried forward with the promptitude and seriousness warranted by the facts of the case. The prolonged pendency of the investigation without any substantial progress has caused grave prejudice to the petitioner and has undermined her legitimate expectation of a fair and effective investigation. 5. Today, the learned AGA has placed on record written instructions received from Sub-Inspector Mr. Vijay Kumar, In-charge, Police Chowki Kainchi Dham, Kotwali Bhowali, which is taken on record. In the written instructions, it has been stated that the documents are being collected from the informant and the accused and the other investigation proceedings are underway, and the police report will be submitted in the court soon. 6. Today, Sub-Inspector Mr. Vijay Kumar, In-charge, Police Chowki Kainchi Dham, Kotwali Bhowali (I.O.) is also present through video conferencing and he has informed that he has already recorded the statements of the informant as well as the accused and after some more proceedings which are left to be undertaken, he will be filing the police report as soon as possible. 7. Mr. R.K. Joshi, learned AGA for the State would submit that the investigation is already underway and the Sub-Inspector who is the IO of the case, has already stated that after collecting the necessary documents etc. he will be filing the police report as soon as possible. 8. After having heard the petitioner in- person and learned AGA for the State, it is apparent that the investigation in pursuance to the FIR No. 0055 of 2025 under Sections 316(2) & 318(2) of the BNS, 2023, PS Bhowali, is underway. The only grievance being raised on behalf of the petitioner in- person is that the investigation is not progressing at the desired pace, and she prays that an order be passed that the investigation be completed by the IO in a time-bound manner. 9. In such view of the matter, the writ petition is disposed of with a direction to the IO, who is present through VC, to investigate the case expeditiously as soon as possible and complete the investigation in view of the provisions of Section 193 of the BNSS, as per law.
