JUSTICE NELSON SAILO ORDER Date : 21.07.2026 Both the Interlocutory Application as well as the Regular First Appeal has been listed today for withdrawal, on a mention made by Mr. A. R. Malhotra, learned counsel for the respondent Nos. 6 to 8. [2.] The learned counsel submits that the Decreetal amount of the Trial Court in Damage Suit No. 3 of 2016 has been complied with by the parties concerned by sanctioning the amount. After the sanction has been made, the amount has also been disbursed to the parties. [3.] In support of his submission, Mr. A. R. Malhotra, learned counsel, has produced the Communication dated 15.06.2026 made by the Deputy Chief Engineer, N.F. Railway, Construction to the Deputy Commissioner of Kolasib district, Mizoram, transferring the fund with details. [4.] The learned counsel, therefore, submits that the appeal as well as the interlocutory application seeking condonation of delay in filing the appeal filed by the N.F. Railway has become infructuous. Page No.# 3/3 [5.] Mr. S. K. Medhi, learned CGC, appearing for the N.F. Railway, agrees to the submission and submits that the matter may be disposed of. [6.] Considering the above, the Interlocutory Application is disposed of as infructuous. [7.] A copy of the Communication dated 15.06.2026 produced by Mr. A. R.
