The petitioner is serving in the CISF. He applied for transfer to his home State in West Bengal. 3. In the communication dated 30th January, 2026 by the Senior Commandant/ CASO, CISF Unit ASG Chandigarh annexed as P-13 page 81 of the writ petition in serial no. ‘f’ it has been mentioned that the petitioner submitted representation for posting to Home Sector/NES-II directly through email without supporting medical papers or documents. 4. Serial no. ‘g’ of the said communication mentions that his case is being considered at Sector level and his representation will be examined and disposed of accordingly. Page 2 5. Learned advocate for the petitioner submits that his representation has not been disposed of till date. 6. Prayer has been made to direct the authority to accept the petitioner’s prayer for transfer in his hometown so that he can meet with his aged ailing mother who very recently has become a widow due to death of his father on 12th April, 2026. 7. It has also been submitted that the petitioner had to undergo surgeries while he was posted at Chandigarh and all his medical documents are available with the authority. 8. Learned advocate representing the respondents submits that the petitioner is repeatedly making representations for returning to his home State. 9. According to the CISF Act, every member of the force is considered to be on duty and is liable to be employed at any location within or outside India. 10. Upon hearing the submission made on behalf of both the parties and on perusal of the communication dated 30th January, 2026 it appears that the petitioner’s representation seeking transfer is pending consideration till date. 11. The concerned authority is directed to take a decision on the petitioner’s representation and dispose of the same in accordance with law at the earliest but positively within a period of four weeks from the date of communication of this order. 12. A reasoned order shall be passed and communicated to the petitioner immediately thereafter. Page 3 13. If any document(s) is/are wanting from the petitioner, then the same shall be communicated to the petitioner who would be obliged to forward the same to the authority. 14. The writ petition stands disposed of. 15. Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court. 16.
