Learned advocate appearing for the petitioner submits that petitioner has been implicated on the basis of statement of co-accused, although the subject matter of the case involves alleged recovery of 12300 bottles of Codeine Mixture. Charges have already been framed. As such, further detention of the present petitioner is unwarranted. Learned advocate for the State opposes the prayer for bail and submits there were 5 phone calls from the petitioner at the relevant point of time. However, learned advocate for the State is unable to refute the contention that the only materials
2 appearing against the petitioner are the CDR and the statement of the co-accused. Similarly placed accused persons have been granted bail in the present case. Having considered that the petitioner is in custody for 11 months and the charge sheet reflects that there are 22 witnesses, on whom the prosecution has relied upon, I am of the view that some time will be consumed in taking the trial of the case to its logical conclusion, as such further incarceration of the present petitioner is unwarranted. Accordingly, prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Morjel Sk @ Morjel Shaikh @ Marjel Shaikh shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Judge, Special Court under NDPS Act, Krishnanagar, Nadia. If on bail, petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Nadia without the prior permission of the learned Special Court.
The petitioner shall meet with the Investigating Officer or any officer deputed by the Superintendent of Police, Narcotic Control Bureau once in every 10 days. Accordingly, CRM (NDPS) 678 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. 3 Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
