By means of the present Criminal Writ Petition, the petitioners have approached this Court seeking the following relief: "i. Issue a writ, order or direction in the nature of mandamus directing respondent nos. 2 and 3 to provide adequate protection to the petitioners." 3. Learned counsel for the petitioners submits that both the petitioners are major and are residing together in a live-in relationship. He further submits that the petitioners undertake to comply with the provisions of Section 381 of the Uttarakhand Uniform Civil Code, 2024, by getting their live-in relationship registered before the competent Registrar, in accordance with law. Learned counsel further submits that the petitioners apprehend a threat to their life and personal liberty at the hands of respondent no. 4, who is the father of petitioner no. 1. Accordingly, the petitioners seek appropriate directions for protection of their life and personal liberty. 4. Having heard learned counsel for the parties and upon perusal of the material available on record, this Court is, prima facie, satisfied that the petitioners have made out a case for consideration of their grievance regarding protection of their life and personal liberty guaranteed under Article 21 of the Constitution of India. The law laid down by the Hon'ble Supreme Court in Lata Singh v. State of U.P. and Another UKHC010140042026 2026:UHC:6965 also recognizes that two major individuals are entitled to choose their partner and cannot be subjected to threats or harassment on account of such choice. 5. Accordingly, the Station House Officer, Police Station Kashipur, District Udham Singh Nagar, is directed to assess the threat perception, if any, to the life and personal liberty of the petitioners. In the event any genuine threat is found to exist, the concerned police authorities shall provide adequate protection to the petitioners strictly in accordance with law. The Station House Officer shall also summon respondent no. 4, as well as any other person found to be interfering with or threatening the petitioners, and counsel them to maintain peace and refrain from taking the law into their own hands. 6. With the aforesaid directions, the present Criminal Writ Petition stands disposed of.
