In compliance to the Order dated 29th April, 2026 passed by this Court in TrP (C) 4/2026, the instant application has been filed by the petitioners for placing on record the apology to show genuine remorse with regard to the allegations leveled in the petition. Registry to diarize the instant application. 02. For the reasons stated in the application, the same is allowed and the apology tendered by the petitioners is taken on record. 03. CM is accordingly disposed of. TrP (C) 4/2026; 04. While hearing this matter, it came to fore that the petitioners had levelled scandalous and unsubstantiated allegations against the Presiding Officer of the court of Sub-Judge, Pattan as well as the Principal District Judge, Baramulla without any proof whatsoever, in Paragraph 4 of the petition, as detailed out in the Order dated 29th April, 2026. 05. This Court in terms of Order dated 29th April, 2026 observed that the tendency of the litigants to level unwarranted, baseless, and scandalous allegations against judicial officers deserves to be curbed with a firm hand. Such allegations, by their very nature, are not directed against an individual Judge in his/her personal capacity, but constitute an affront to the dignity, independence, and institutional integrity of the judiciary. The sanctity of judicial proceedings cannot be permitted to be sullied by reckless pleadings which, under the guise of advocacy, seek to malign the judicial process. 06. This Court further observed that any indulgence shown in such matters would embolden litigants to adopt similar tactics, thereby eroding public confidence in the justice delivery system. It is, therefore, imperative that such conduct be dealt with strictly and in accordance with law, so as to preserve the majesty of law and the credibility of the institution. Since the petitioners have levelled scandalous allegations in the instant matter without any basis or corroboration, this Court, in the first instance, directed the petitioners to file an unconditional apology, as also showing genuine remorse for such allegations, with a clear undertaking that they shall remain cautious in future and shall refrain from making any such unfounded allegations. The said direction stands complied with by the petitioners. 07. Since the petitioners have tendered an unconditional apology, showing genuine remorse for the allegations levelled in the instant petition and have also undertaken that they will be careful in future and refrain from making any such unfolded allegations, the learned counsel for the petitioners, who is also directed to remain cautious in future and ensure that pleadings are drafted with due care, responsibility and proper verification, seeks withdrawal of the instant petition 08.
