The petitioner named above has been made accused in connection with Sarath P.S. Case No. 62 of 2025 for the offence registered under Sections 70(2) of the Bhartiya Nyaya Sanhita, 2023 and Section 4/6 of POCSO Act, pending in the court of learned Special Judge POCSO, Deoghar It is submitted by learned counsel for the petitioner that it is a case of willful elopement of the victim girl with the principal accused Rohit Verma and the only allegation against this petitioner is that he had also accompanied the main accused. There is no allegation of sexual assault against this petitioner. It is contended that another co-accused Nitish Kumar Verma has been granted bail by the Co-ordinate Bench of this Court in B.A. No. 9637 of 2025. Learned APP has opposed the prayer for bail. Considering the fact that there is no sexual assault against this petitioner, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each, to the satisfaction of learned Court below.
