This application under Section 5 of the Limitation Act is preferred by the applicant Page No.# 2/2 for condonation of delay of 52 days in filing the connected civil revision petition arising out of the impugned judgment and order dated 11.09.2025 and the decree passed in Title Appeal No.11/2019 by the learned Civil Judge (Sr. Division), Kamrup, Amingaon. The learned counsel for the applicant submits that due to misplace of some of the case related documents the revision petition could not be prepared and filed in time and that the delay is not intentional rather it is circumstantial and the same has been explained in paragraph Nos.3, 4 and 5 of this application and under such circumstances, he has contended to condone the same. Mr. Choudhury, learned counsel for the opposite party however submits that he has no objection. Accordingly, taking note of the submission of learned counsel for both the parties and also considering the explanation so forthcoming for the delay of 52 days in preferring the connected civil revision petition, this Court is of the view that the delay is sufficiently explained and accordingly, the same stands condoned. In terms of above, the I.A. stands disposed of. Now the Registry shall proceed to register and number the connected civil revision petition and list the same before the Court as soon as practicable.
