This Criminal Miscellaneous Petition has been filed with the prayer to modify the order the dated 17.12.2019 passed by this Court in A.B.A. No. 7058 of 2019 by which the petitioners were granted the privileges of anticipatory bail with the condition that the petitioners will not go over or near the place of occurrence land bearing plot No. 73, Khata No. 21 in village Sirsia P.S. Giridih, District Giridih and on producing the certificate from the concerned Forest Officer that the petitioners have vacated the plot No. 73, Khata No. 21 in village Sirsia. Learned counsel for the petitioners submits that the allegation against the petitioners is false. The petitioners have purchased the place of occurrence land from the rightful owner through a valid sale deed. Hence, it is submitted that the prayer as prayed for in this Criminal Miscellaneous Petition be allowed. Learned counsel appearing for the State on the other hand vehemently opposes the prayer of the petitioners made in this Criminal Miscellaneous Petition and submits that the petitioners were given the privileges of anticipatory bail vide the dated 17.12.2019 passed by this Court in A.B.A. No. 7058 of 2019 only upon the petitioners voluntarily showing their readiness and willingness to vacated the said land till disposal of this case. It is next submitted that now, after getting the breather from arrest, in the shape of anticipatory bail for six years, they have come with a new ground for the first time to evade their arrest. Hence, it is submitted that this Criminal Miscellaneous Petition, being without any merit, be dismissed. Having heard the submissions made at the Bar and after carefully going through the materials available in the record, this Court finds that the petitioners were given the privileges of anticipatory bail on their voluntarily making submission before this Court on 17.12.2019 that they are ready and willing to vacate the said land till disposal of this case and upon such submission made by them, they have been granted the privileges of anticipatory bail . But as without any rhyme or reason the petitioners intend to depart from their submission, so it is crystal clear that the petitioners have not come to the Court with clean hands and there is no justifiable reason to interfere with the dated 17.12.2019 passed by this Court in A.B.A. No. 7058 of 2019.
