Mr. Indrajit Chatterjee …for the Petitioner Mr. Partha Pratim Das Mr. Kaustav Banerjee …for the State 1. Learned Advocate for the petitioners submits that the petitioners are the husband, father-in-law and the grandmother in law of deceased. They are in custody for 104 days. Charge-sheet has been submitted. As such the petitioners may be released for bail. 2. Learned advocate for the State opposes the prayer for bail particularly on the ground that within five months of marriage the victim/deceased being unable to bear the torture terminated her life. 3. I have taken into account the statement of the witnesses, post-mortem report and I am of the opinion that as sixteen 2 witnesses have been relied upon in the charge-sheet and some time will be required to take the trial to its logical conclusion. Further detention of the petitioners may not be warranted in the facts of the case. As such the prayer for bail is allowed. 1. Accordingly, Petitioners, namely, 1. Sumit Badyakar 2. Mukaddar Badyakar @ Muku Bayar 3. Chaina Badyakar shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned CJM, Paschim Bardhaman. 2. If on bail, petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Paschim Bardhaman without the prior permission of the learned Court. Additionally, petitioner no. 1 shall meet with the Officer-in- Charge of Raniganj Police Station once in a fortnight till the evidence of the vulnerable witnesses are concluded. 3. Accordingly, CRM (M) 670 of 2026 is allowed. 4. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. 5. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
