The petitioner is a retired Lecturer (Physics). He was initially appointed as an Assistant Teacher (L.T. Grade) (Science and Mathematics) on 28.08.1981. Subsequently, he was promoted to the post of Lecturer (Physics), from which post he ultimately retired on 31.07.2009. 2. The petitioner after retirement staked claim for selection grade as well as promotional grade to be paid to him w.e.f., from date of his entitlement. 3. For the said benefit, the petitioner moved several representations to the respondent no.3-Additional Director (Education), Kumaon Division, Nainital, amongst which 16.03.2026 is the latest one, annexure no.8 to the writ petition. 4. It is contended by learned counsel for the petitioner that the aforesaid representation is pending disposal with respondent no.3-Additional Director (Education), Kumaon Division, Nainital and if he is directed to decide the representation dated 16.03.2026, annexure no.8 to the writ petition, in a time bound manner, ends of justice would be met. 1 UKHC010140032026 2026:UHC:7090 5. Learned counsel for the State submits that the appointing authority of the Lecturer is respondent no.2- Director, Secondary Education, therefore the representation should have been made by the petitioner to the respondent no.2-Director, Secondary Education and not to Additional Director, Kumaun Division, Nainital. 6. This Court finds substance in the submission made by learned State counsel. 7. In view of the aforesaid, the writ petition is finally disposed of with liberty to the petitioner to submit a fresh representation before respondent no.2-Director of Secondary Education, within a period of two weeks from today. In the event that such a representation is submitted by the petitioner within the aforesaid period, respondent no.2-Director of Secondary Education, shall consider and decide the same within a further period of three months from the date of receipt thereof.
