The challenge in the present writ petition is to the detention order dated 11.03.2026 (Annexure P-1), whereby the petitioner has been detained for a period of three months and kept in the District Jail, Solan District Solan Himachal Pradesh under the PIT ND&PS Act, 1988 on account of the involvement in two FIR’s, of NDPS registered against him, the details of which are mentioned as under:-
“i. FIR No.54/2025 dated 17.03.2025, Police Station Dharampur, District Solan, HP under Sections 21, 29 of the ND&PS Act, 1985, wherein approximately 10.70 grams of heroin/chitta was recovered from him. 1 Whether reporters of Local Papers may be allowed to see the judgment?
2 ii. FIR No.150/2025 dated 31.08.2025, Police Station Dharampur, District Solan, HP. Under Sections 21, 29 of the ND&PS Act, 1985, wherein approximately 04.73 grams of heroin/chitta was recovered from him.”
2. It is pertinent to mention that we have already quashed the detention order of his brother namely Gaurav in Cr.WP No.16 of 2026, titled Gaurav Vs. State of Himachal Pradesh and others, and we find that for the reasons given in the aforesaid order, the present petition is liable to be allowed.
3. Resultantly, we allow the present petition and the detention order dated 11.03.2026 (Annexure P-1) is quashed. The petitioner be set free in case he is not wanted in any other case.
4. Pending application(s), if any, shall stands disposed off accordingly.
