Sarma, learned Additional Public Prosecutor, Assam. 2. This is an application under Section 482 of BNSS, 2023 praying for grant of pre-arrest bail to the accused/petitioner, namely, Aajghar @ Abdul Jabbar who is apprehending arrest in connection with the Gohpur P.S. Case No. 04/2026 under Sections 61(2)/308/316(2)/318(4) of the BNS, 2023. 3. The allegations in the FIR alleged that the accused persons named in the FIR have sold fake gold to the informant for Rs.27,00,000/- and thereby cheated them. 4. The Court by order dated 05.05.2026 had granted interim protection to the petitioner, pursuant to which, he had appeared before the I.O. and his statement was recorded. 5. On perusal of the case diary, it is seen that the I.O. has noted that the accused has cooperated with the investigation of the case and accordingly, he has been released after serving a notice under Section 35 of the BNSS with an instructions to appear before the I.O. whenever summoned for further questioning. 6. Having regard to the above, it appears that the custodial interrogation of the petitioner may not be necessary. Page No.# 3/3 7. Accordingly, the prayer for pre-arrest bail is allowed. 8. The order of interim pre-arrest bail dated 05.05.2026 is hereby made absolute on the condition that the petitioner shall continue cooperation with the I.O. 9.
