Pathak, learned counsel for the petitioner, who has approached this Court by the rejection of the technical bid of the petitioner in connection with Tender No. CE-CON-KJG- EPC-2026-03 vide Email dated 08.07.2026. It is contended that no detail reasons were indicated and a cryptic remark of “not fulfilling technical threshold capacity” was reflected. Shri H. Gupta, learned CGC appearing for the Railways has, however, submitted that the representation submitted by the petitioner was considered and disposed of and the tender was also finalized and discharged. By placing the written instructions dated 17.07.2026, Shri Gupta, learned CGC has submitted that upon the evaluation of the bids of the remaining tenderers, none Page No.# 3/3 of the bids were found suitable and accordingly, the tender was discharged. In view of the above, this Court is of the opinion that the present challenge would be mere academic and therefore, the instant writ petition is closed.
