Impugned in this petition filed by the Union Territory of Jammu & Kashmir is an order and judgment dated 17th March, 2025 passed by the Central Administrative Tribunal, Srinagar Bench [“the Tribunal”] in OA No. 6/2021 titled “Tasweef Ahmad Wani Vs. Government of J&K and Ors”, whereby the Tribunal has allowed the OA filed by the respondents herein and directed the petitioners herein to consider the claim of the applicants in the OA in the lights of the directions passed by the Tribunal in various OAs decided on different dates and take a decision in the matter within a period of two months by passing a speaking order. 02. The issue raised by the petitioners in this petition already stands considered and decided by this Court in a batch of petitions, with lead case being WP(C) No. 164/2025 titled “Union Territory of J&K and Ors. Vs. Imtiyaz Ahmad Laloo and Ors.”. We have gone through the judgment impugned and are of the considered opinion that the case of the petitioners is squarely covered by the judgment passed in Imtiyaz Ahmad Laloo (supra) and, therefore, needs no further adjudication. Accordingly, this petition is disposed of in terms of judgment passed in Imtiyaz Ahmad Laloo (supra), with the following directions:- (i) The respondents herein shall be deemed to have been appointed as Constables in J&K Police (Executive) in their respective Districts prior to 01.01.2010 and, therefore, they shall be held entitled to the benefit of the Pension Rules as were existing and applicable to the Government employees prior to 01.01.2010; (ii) The date of appointment of the respondents is preponed only for enabling them to take the benefit of Old Pension Scheme and for no other purpose; and, (iii) The requisite steps for complying with this judgment and setting the record straight by issuing a formal order shall be taken by the petitioners within a period of three months from the date of the judgment. 04.
