Learned advocate appearing for the petitioner submits that the petitioner is in custody since 28th of August, 2025, all the accused persons have been arrested and rest of the accused persons have been granted bail. Learned advocate for the State opposes the prayer for bail and submits that the present petitioner is the principal accused to whom the amount has been transferred. Having regard to the period of detention of the present petitioner and the other accused who aided the petitioner have been granted bail and without entering into the merits of the case, I am of the opinion that some time will be required to take the trial to its logical conclusion. At this stage, further detention of the present petitioner is unwarranted. Accordingly, the prayer for bail of the petitioner is allowed.
2 As such, petitioner namely, Lalu Sk shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Additional Chief Judicial Magistrate, Kandi, Murshidabad. However, the learned Court in seisin of the case is directed to accept the bonds after the case is committed to the Court of Sessions. If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial Court and shall not leave the jurisdiction of District of Murshidabad without prior permission of the learned trial Court. Thus, CRM (M) 760 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
