JUSTICE SANJAY KUMAR MEDHI ORDER 20.07.2026 Heard Shri AFNU Mollah, learned counsel for the petitioner, who has alleged willful and deliberate disobedience of the order dated 18.02.2026 passed in WP(C)/885/2026. Page No.# 2/2 Ms. P. Thapa, learned counsel appearing on instructions of Shri S. Dutta, learned counsel for the sole respondent has, however, placed before this Court a copy of an order dated 15.07.2026 passed by the Department in pursuant to the aforesaid order of this Court. On a perusal of the said order dated 15.07.2026, it is noticed that the three markets, namely, i) Rowmari Daily Market, ii) Rowmari Weekly Market and iii) Rowmari Cattle Market are spread over a contiguous area concerning two Gaon Panchayats, namely, i) Rowmari Gaon Panchayat (covered by Dag no. 380 of Government land) and ii) Ramharirchar-Khankhowa Gaon Panchayat (partly covered by Dag Nos. 662, 666, 1081 of patta land and Dag no. 673of Government land). By applying Clause 15 of the Government Executive Order dated 20.05.2025, it was directed that the settlement of the aforesaid three markets be undertaken by the Kamakhyabari Anchalik Panchayat under which, both the Gaon Panchayats exist. In the opinion of this Court, the aforesaid order dated 15.07.2026 would amount to substantial compliance of the order of this Court dated 18.02.2026 passed in WP(C)/885/2026. The contempt petition accordingly stands disposed of. It is needless to mention that any person aggrieved by the said order dated 15.07.2026 would be at liberty to challenge the same in an appropriate Court.
