The petitioner is apprehending his arrest in connection with Mirzachouki P.S. Case No. 41 of 2020, registered for the offence under Sections 379, 414, 467, 468 and 471 of the Indian Penal Code and Rule-54 of Jharkhand Minor Mineral Concession Rules, 2004, pending in the court of learned Sub-Divisional Judicial Magistrate, Sahibganj. 3. Learned counsel appearing for the petitioner submits that the petitioner is also one of the driver of the truck and in the present case 139 trucks with fake challans have been seized. He next submits that in the similar circumstance, several other co-accused persons have already been provided privilege of anticipatory bail by the coordinate Bench of this Court in different FIRs in ABA No. 1970 of 2021, ABA No. 3485 of 2021, ABA No. 2146 of 2021, ABA No. 880 of 2021, ABA No. 6555 of 2021, ABA No. 3742 of 2021, ABA No. 2755 of 2021, ABA No. 7280 of 2021, ABA No. 7922 of 2021 and ABA No.9699 of 2021 and in A.B.A. No. 1074 of 2023 by this court. 4. Learned A.P.P. appearing for the State has opposed the [2026:JHHC:11504] -2- prayer and submits that on certain conditions, those anticipatory bail were allowed. 5. In view of the above and considering the fact that the co- accused have been provided privilege of anticipatory bail, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the petitioner, named above, is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sahibganj, in connection with Mirzachowki P.S. Case No. 41 of 2020, subject to conditions as laid down under Section 482 (2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and the petitioner will not change his mobile number which is indicated in his Aadhar Card.
