Since in all the bail applications, the o;ence arise from similar crime number, as all the bail applications have been clubbed together, heard together and disposed of by this common order. 2. These are the <rst bail applications <led under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicants who has been arrested in connection with Crime No. 406/2025 registered at Police Station Basna, District – Mahasamund (C.G.), for the o;ence punishable under Sections 4, 6 and 10 of the Chhattisgarh Agricultural Cattle Preservation Act. 3. The case of the prosecution, in brief, is that the police of the Police Station Basna received secret information that certain unknown persons were transporting 35 calves in a truck for the purpose of slaughter. On the basis of such information, the police seized 35 animals from the possession of the applicants and implicated him in connection with the aforesaid o;ence under Sections 4, 6, and 10 of the Chhattisgarh Agricultural Cattle Preservation Act, on the basis of a memorandum statement. 4. Learned counsel for the respective applicants submits that the 3 applicants have been falsely implicated in the case. It is further submitted that present applicants have no criminal antecedents and they are in jail since 06.10.2025, conclusion of the trial may take some time, therefore, they pray for grant of regular bail to the present applicants. 5. On the other hand, learned State Counsel opposes the bail applications of the present applicants. 6. I have heard learned counsel appearing for the parties and perused the case diary. 7. Taking into account the facts and circumstances of the case, the submissions of learned counsel for the parties, and the material on record, and further considering the fact that the present applicants have no criminal antecedents and have been in jail since 06.10.2025, and that the conclusion of the trial may take some time, this Court is of the opinion that the applicants are entitled to be enlarged on regular bail. 8. Let the applicants, namely, Sachin Chandrashekhar Gajbhiye, Jitendra Bhavrao Dharade, Ranglal @ Ramlal Meena, Lakhan Ratre and Vinod Bhagwat Bandey, involved in Crime No. 406/2025 registered at Police Station Basna, District – Mahasamund (C.G.), for the o;ence punishable under Sections 4, 6 and 10 of the Chhattisgarh Agricultural Cattle Preservation Act be released on bail on their furnishing personal bond with two sureties each in the like sum to the satisfaction of the Court concerned with the following conditions:- (i) The applicants shall <le an undertaking to the e;ect that they shall not seek any adjournment on the dates <xed for evidence when the witnesses are present in Court. In case of default of this condition, it shall be open for the trial court to 4 treat it as abuse of liberty of bail and pass orders in accordance with law. (ii) The applicants shall remain present before the trial court on each date <xed, either personally or through their counsel. In case of their absence, without su6cient cause, the trial court may proceed against them under Section 229-A of the Indian Penal Code. (iii) In case, the applicants misuse the liberty of bail during trial and in order to secure their presence, proclamation under Section 82 Cr.P.C. is issued and the applicants fail to appear before the Court on the date <xed in such proclamation, then, the trial court shall initiate proceedings against them, in accordance with law, under Section 174-A of the Indian Penal Code. (iv) The applicants shall remain present, in person, before the trial Court on the dates <xed for (i) opening of the case, (ii) framing of charge and (iii) recording of statement under Section 313 Cr.P.C. If in the opinion of the trial Court absence of the applicants are deliberate or without su6cient cause, then it shall be open for the trial Court to treat such default as abuse of liberty of bail and proceed against them in accordance with law. 9. 9.
