Heard learned counsel for the parties.

The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 302/34 IPC in connection with S.T. Case No. 601 of 2024 arising out of Dhanbad PS Case No. 271 of 2024 corresponding to G.R. Case No. 2042 of 2024.

Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. Learned counsel for the petitioner submits that from the seizure list, it appears that nothing was recovered from the possession of the petitioner and there is no eye witness to the occurrence and also there is no specific material found as against the petitioner save and except confessional statement, which has no value in the eyes of law. Despite of the fact that the case of the prosecution is devoid of any substantiating evidence the petitioner has been made accused. Learned counsel for the petitioner further submits that in this case, charge has been framed and co-accused, namely, Prem Dome @ Sona Dome in B.A No. 2300 of 2025 has been granted bail vide order dated 06.08.2025 by the Co-ordinate Bench of this Court and the petitioner is languishing in judicial custody since 23.08.2024. As such, learned counsel for the petitioner submits that the petitioner may be enlarged on bail.

Learned APP opposes the prayer for bail of the petitioner.

Having regard to the fact that co-accused in B.A No. 2300 of 2025 has been granted bail vide order dated 06.08.2025 by the Co-ordinate Bench of this Court coupled with the fact that there is no eye-witness to the occurrence and the petitioner is lying in judicial custody since 23.08.2024, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above-named is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-V, Dhanbad in connection S.T. Case No. 601 of 2024 arising out of Dhanbad PS Case No. 271 of 2024 corresponding to G.R. Case No. 2042 of 2024.

It is made clear that the petitioner shall appear on each and every date before the learned trial Court and he shall not threaten any witness and shall co-operate in trial and if any adverse report will come against the above-named petitioner, learned trial Court shall be at liberty to cancel the bail of the above-named petitioner.

Accordingly, the instant bail application stands allowed.
