Dubey, AC to AG For the NHAI : Mrs. Sweety Topono, Advocate Mr. Amrit Raj Kisku, Advocate -------- 02/04.05.2026: In this Writ petition, the petitioners have prayed for direction upon the District Land Acquisition Officer, Chatra-Cum-Competent Authority to refer the matter in relation to payment of compensation under Section 3(H) (4) to the Court of Principal Civil Judge, Chatra under the Provisions of National Highways Act, 1956. 2. It is submitted by petitioner that the District Land Acquisition Officer, Chatra is not referring the dispute before the Principal Civil Judge, Chatra under the provisions of National Highways Act, 1956. 3. Mr. Mohan Kr. Dubey appears on behalf of the State submits that if the matter is still pending the Competent Authority will take appropriate steps in terms with the provisions of the National Highways Act, 1956 and will refer the dispute to the Principal Civil Judge, Chatra, if there is no legal impediment. 4. Considering the aforesaid submissions, this application is disposed of with the direction to the respondents to consider the case of the petitioner and refer the matter, as per law, to the Principal Civil Judge, Chatra, if there is no other legal impediment, where the grievance of the petitioner can be redressed in terms of National Highways Act, 1956.
