Learned advocate for the defacto-complainant is present and opposes the prayer for bail. Learned advocate for the State produces the case diary and has drawn the attention of the court to the relevant materials which were collected in course of the investigation including the statement of the victim under section 164 of the Cr.P.C. as well as the medicolegal examination report. 2 I have taken into account the materials which are appearing as also the fact that the petitioner was evading the process of law for about eight months after the case was registered. Having considered the same, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected. However, last of the two dates in the year 2026, it reflects that none of the witnesses are present. Accordingly, I direct that the learned Special Court would take steps for compelling the witnesses to appear so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. Accordingly, CRM (M) 703 of 2026 is dismissed. Report submitted be kept with the record.
