Page No.# 3/3 Kalita, learned counsel appearing on behalf of Mr. A.C. Sarma, learned Senior counsel for the respondent/opposite party No.1. This application under Order XXII Rule 4 of the Code of Civil Procedure is preferred by the applicant for substitution of legal heirs of the respondent No.14, who suffered demise on 14.04.2026. The learned counsel for the applicant submits that the applicant has preferred one regular second appeal, being RSA No.175/2025 and in the said RSA No.175/2025, the respondent No.14 suffered demise and as such, there is a requirement of bringing on record the legal heirs of the said respondent and as such, he has contended to allow this application.
The learned counsel for the opposite party No.1 submits that she has no objection. Accordingly, taking note of the submission of learned counsel for both the parties, this interlocutory application stands allowed. The legal representatives of respondent No.14 be substituted in the RSA No.175/2025. In terms of above, this I.A. stands disposed of.
