Namkum, District Ranchi, Jharkhand. … … Respondents ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Kripa Shankar Nanda, Advocate For the Respondent(s): Mr. Sanjoy Piprawall, Advocate Mr. Rakesh Ranjan, Advocate Mr. Prince Kumar, Advocate Mr. Jay Prakash, Advocate ------ 03/ 17.02.2026 By filing this writ petition, the petitioner has prayed for the following reliefs:- i. “for issuance of an appropriate writ(s), order(s) or direction(s) or writ in the nature of mandamus commanding/directing the Respondent Nos.3 and 4 to issue the appointment letter in favour of the petitioner for the post of Sahayak Acharya (Assistant Teacher) under the Para Teacher Category as the petitioner has already been declared successful in the examination of Jharkhand 2026:JHHC:4921 2 Primary School Trained Assistant Teacher (Sahayak Acharya) joint Examination, 2022 (Advertisement No. 13/2023) and same has been published vide information dated 28/07/2025, and he has also appeared as per the Schedule having Roll No. 421318083, and he has already submitted all his testimonial as per the Schedule given by the Respondent Authorities however till date no formal appointment letter has been issued in his favour though other who are similarly situated persons have been appointed and have joined. AND / OR For issuance of an appropriate writ(s), order(s) or direction(s) or writ in the nature of mandamus commanding upon the respondent to publish separate merit list/appointment for para-teacher category in accordance with the 50% reservation provided in Clause-6 of the Advertisement No. 13/2023. AND / OR For issuance of further direction(s) upon the respondents to stay the appointment process till the disposal of the instant writ petition or reserve the seats for the writ petitioners subject to outcome of the present writ petition.” 2. Heard learned counsel representing the petitioner and learned counsel representing the respondents. 3. Pursuant to an interim order dated 10.02.2026 passed in a writ petition being W.P.(S) No.813 of 2026 (Shriram Prasad & Ors. Vs. The State of Jharkhand & Ors.), the respondents have uploaded the normalized marks of each of the candidates who has participated in the examination. They have also published the cut-off marks on 2026:JHHC:4921 3 16.02.2026. 4. It is the case of the petitioner that result was declared and the petitioner was also called for the document verification. 5. Admittedly the petitioner has got lesser marks than the cut-off marks in the category and subject of the petitioner. 6. Merely calling the petitioner for document verification after declaration of the result cannot give any right to the petitioner unless the petitioner can prove that he has obtained more marks than the last selected candidates, which the petitioner has failed to do in this case. 7. Thus, considering the aforesaid facts, no relief can be granted to the petitioner as the petitioner has obtained lesser marks than the cut-off marks. 7.1. However, if in future, it is found that any person obtaining lesser marks than the petitioner in the category and subject of the petitioner, has been appointed, it will be open to the petitioner to approach this Court. 8.
