4. By means of the present writ petition, petitioner seeks the following reliefs:- (a) Issue a writ order or direction in the nature of mandamus directing the respondents to ensure the safety and security of the petitioner and his family members from the respondent no. 3 and his associates.”

Today, learned counsel for respondent no. 3 submits that since petitioner has handed over the possession of the public toilet and the accommodation, which was adjacent to the toilet, situated at Rikshaw Stand, Tallital, Nainital, as such, now, no dispute remains regarding possession of public toilet or the residence. It is further submitted that that respondent no. 3 is a law abiding citizen and, as such, in the past also, he has never threatened the petitioner and it is assured
that in future also, he will not extend any threat to the petitioner and his family members.
7. In view of the aforesaid submission, the writ petition stands disposed of.
